This site compartmentalizes Production, Abandonment, and Drilling field activities in the same manner most oil & gas operational divisions are segmented and federal regulations are posted. There are overlapping rules in limited areas, but we’ll do our best to provide relevant information specific to the task at hand by filtering regulatory topics that are not essential to the current activity. For example, a drilling consultant does not need to know how to calculate linear interpolation of a LACT meter factor and a gas measurement tech do not need to know what weight mud to use in a well abandonment. More importantly the federal oil and gas Operator of Record is absolutely responsible for all regulatory violations including third-party infractions. Operational responsibility cannot be delegated away.

 

The BLM manages the federal government’s onshore subsurface mineral estate held by the BLM, U.S. Forest Service and other federal agencies and surface owners for the benefit of the American public. It also manages some aspects of the oil and gas development for Indian tribes from the tribal mineral estate by working cooperatively with the Bureau of Indian Affairs (BIA). The BLM’s authority to manage the public’s oil and gas resources in the 48 contiguous states comes from two laws -- Mineral Leasing Act of 1920 as amended and the Mineral Leasing for Acquired Lands Act of 1947. Most regulations that govern operations associated with the exploration, permitting, development and production of onshore oil and gas deposits on federal leases can be found under Title 43, subpart 3160 of the Code of Federal Regulations (43 CFR 3160-3165) and Title 43, subpart 3170 of the Code of Federal Regulations (43 CFR 3170-3179). Additional federal regulations such as Onshore Orders and Notices to Lessees (NTLs) are applicable at a national level, whereas local NTLs specific to an operational area may be issued by each BLM state office.

 

The lack of a working knowledge of federal regulations may result in a compliance violation known as an Incident of Noncompliance (INC). Certain instances of noncompliance may require a $1,000 immediate assessment per violation whereas minor violations may be assessed up to $250 per violation contingent to regulatory provisions. All INCs will require a corrective action by a predetermined abatement that will lead to additional INCs and/or civil penalties if the operator fails to comply. The number of INCs issued to an operator of record will shorten the BLM inspection frequency schedule, may trigger a bond review, could cause a shutdown order, and even cancel a lease.
